What is a FEHA Claim?
FEHA stands for a California law called the Fair Housing and Employment Act. Traditionally, it has been applied on behalf of employees who have been victims of employment discrimination and harassment in the workplace. The law can also be used in cases of disability discrimination, particularly workers who have lost wages or been fired after a workplace accident that has left them unable to perform their job duties without reasonable accommodation.
If the employee wins a FEHA claim, he or she is entitled to past lost wages. In some cases the employee may also be entitled to damages for pain and suffering and punitive damages as well. The employee's attorney fees must be paid by the employer.
